Terms of Service

These Terms of Service ("Terms") govern your use of this website (the "Site") and your download and use of Lotus Browser and SysInfo by Lotus (each a "Product", together the "Software"), as well as the Lotus share service at share.browselotus.net (the "Share Service"). By downloading, installing, or using the Software or the Share Service, you agree to these Terms. If you do not agree, do not download or use them.

1. Software license

Lotus Browser and SysInfo are provided to you free of charge and are licensed under the Lotus Source-Available License (the "License"). The full text is on our Software License page and is published with each Product's source code.

In short, the License lets you download, view, and run the Software, and modify it for your own personal use. It does not let you distribute, publish, sublicense, or sell the Software or any modified version of it, or use it for commercial purposes. If these Terms and the License differ on your rights in the Software, the License controls.

2. SysInfo and the Share Service

SysInfo is a utility that creates a report of your system's hardware and software. It is licensed under the License described in Section 1, which makes its source code available to view but does not make it open source. The rest of this section applies to the optional Share Service.

SysInfo can optionally upload a report to the Share Service, which gives you a link to it. By uploading a report you agree that:

  • Anyone who has the link can view the report, so you are responsible for who you give it to;
  • You will only upload reports generated by SysInfo, and you will not alter them to include unlawful, harmful, or other people's personal content;
  • Reports are kept for 30 days and then removed, and we may remove a report earlier if it breaches these Terms or to protect the service;
  • You will review a report before sharing it, as SysInfo's privacy filter removes only the identifiers described in the Privacy Policy.

3. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to download or use the Software or the Share Service. If you are under the age of majority where you live, you may only use them with the involvement and consent of a parent or legal guardian.

4. Acceptable use

When using the Site, the Software, or the Share Service, you agree not to:

  • Use them for any unlawful purpose or in violation of any applicable local, state, national, or international law;
  • Attempt to gain unauthorized access to our servers, the Share Service, or any related systems, or to other people's uploaded reports;
  • Distribute, publish, or otherwise make available the Software, or any modified version of it, to others, except as the License allows;
  • Use the Software or the Share Service to transmit malware, or to interfere with the security or normal operation of any device, network, or service, including by automated or excessive uploads.

5. Third-party services

Lotus Browser's address bar and new tab search are powered by DuckDuckGo. Your use of DuckDuckGo's search service is subject to DuckDuckGo's own terms and privacy practices, which we do not control. Any website you visit using Lotus Browser is likewise governed by that website's own terms and policies. Our source code and some downloads may be hosted on GitHub, and sign-in on this Site uses Discord, each under their own terms. We are not responsible for the content, availability, or practices of third-party sites or services.

6. Updates and availability

We may release updated versions of the Software from time to time, which may add, change, or remove features. We do not guarantee that any particular version of the Software, the Share Service, or this Site will remain available indefinitely, and we may modify or discontinue any of them at any time without liability to you.

7. Intellectual property

Lotus, including its name, logo, and design, and the source code of both Products, is the property of its creator and is protected by applicable intellectual property laws. The Software is licensed, not sold, and the License grants only the rights it states. It does not grant any right to use the Lotus name or logo. Nothing in these Terms transfers any ownership rights to you.

8. Disclaimer of warranties

The Software and the Share Service are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that they will be uninterrupted, error-free, or completely secure. SysInfo reports are generated from information your system provides and may be incomplete or inaccurate, particularly on Linux, where some Windows-specific details are unavailable.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of, or inability to use, the Software or the Share Service, even if we have been advised of the possibility of such damages.

10. Termination

These Terms remain in effect until terminated. Your license to the Software ends automatically if you breach the License, as the License provides, and we may suspend your access to the Share Service at any time if you fail to comply with these Terms. You may terminate this agreement at any time by deleting all copies of the Software and ceasing all use of it.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Software or the Share Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which the Software's creator resides, without regard to conflict-of-law principles, unless otherwise required by mandatory consumer protection laws applicable to you.
